STATEMENT OF COMPLIANCE UNDER THE INFORMATION TECHNOLOGY (INTERMEDIARY GUIDELINES AND DIGITAL MEDIA ETHICS CODE) RULES, 2021
Nexlive (hereinafter referred to as “the App”) operates as a Social Media Intermediary within the meaning of the Information Technology Act, 2000 and complies with the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021 (hereinafter referred to as the “Rules”).
The App has adopted appropriate policies, procedures, and technological measures to ensure compliance with the applicable provisions of the Rules.

  1. Policies and User Awareness
    Nexlive has published and made accessible to all users the following policies (collectively referred to as “App Policies”):
    Privacy Policy
    Terms of Use
    Community Guidelines
    These App Policies are available within the App and are easily accessible to users at all times. Users are informed that non-compliance with these policies may result in:
    Removal or disabling of access to non-compliant content
    Temporary suspension or permanent termination of user accounts
    Forfeiture of virtual assets or balances, where applicable
    Users are notified of material updates to the App Policies periodically and at least once in each calendar year, as required under the Rules.
  2. Content Regulation and Prohibited Information
    In addition to complying with applicable laws, Nexlive expressly prohibits users from publishing, uploading, streaming, sharing, or transmitting any content that:
    Is invasive of another person’s bodily privacy or harasses or harms individuals based on gender, particularly children
    Is patently false or misleading while presented as factual
    Impersonates another person with the intent to deceive, defraud, or cause wrongful loss or gain
    Threatens the unity, integrity, defense, security, or sovereignty of India, friendly relations with foreign states, or public order
    Violates any law for the time being in force
    Nexlive enforces a strict No Nudity Policy. Any content containing nudity, sexually explicit material, or sexually suggestive conduct is removed immediately or access to such content is disabled without notice.
  3. Proactive Monitoring Measures
    In accordance with Rule 3(4) of the Rules, Nexlive endeavours to deploy reasonable and proportionate technology-based measures, including automated tools, to proactively identify and limit the dissemination of prohibited content, while respecting user privacy and freedom of expression.
  4. Compliance with Legal and Government Orders
    Any order or direction issued by a competent court or an authorised government agency under applicable law or the Rules may be addressed to the Resident Grievance Officer at:

    Upon receipt of a valid order:
    Nexlive shall remove or disable access to the identified content within 36 (thirty-six) hours, or such shorter period as specified in the order.
    Where required, Nexlive shall provide information or assistance under its control or possession within 72 (seventy-two) hours, provided the request clearly states its lawful purpose.
  5. Data Retention
    In compliance with Rule 3(1)(h) of the Rules:
    User registration information shall be retained for 180 days from the date of cancellation or withdrawal of registration.
    Content or information that has been removed or access to which has been disabled shall be preserved for 180 days, or for such longer duration as may be required by a court or authorised government agency for investigation purposes.
  6. Grievance Redressal Mechanism
    Nexlive has established a Grievance Redressal Mechanism in accordance with Rule 3(2) of the Rules.
    Details of the grievance process, timelines, and user rights are provided in the section titled “Grievance Redressal Process” within the App.
    All user grievances are acknowledged within 24 hours and resolved within 15 days, unless extended due to legal or investigative requirements.
  7. Identification of First Originator
    Where required under a lawful order issued in accordance with Rule 4 of the Rules, Nexlive may assist competent authorities in identifying the first originator of information, subject to applicable legal safeguards and privacy protections.
  8. Ongoing Compliance
    Nexlive remains committed to continuous compliance with the Information Technology Act, 2000 and the Rules framed thereunder, and shall update its policies, procedures, and technical safeguards as required to reflect changes in law or regulatory guidance.
